Different Aspects of the Brazilian Legal System and Qualifications to be a Lawyer in Brazil

Brazil is commonly dubbed as a civil law nation since it draws its law from the civil law of several countries such as Germany, Portuguese, Italy and French. The Brazilian legal system is mainly based on legislation and codes, which are passed by the federal legislature power as well as the legislatures from municipalities and states.

The Brazilian judicial organ is tasked with the role of enforcing the Federal Constitution, which is used to govern the country. As such, the judicial system consists of specialized and ordinary courts. The specialized courts are held entirely by the Federal Government, and are divided according to three fields of practice including electoral, labor and military courts. On the other hand, the ordinary courts are shared between States and Federal judiciaries. Further, the judicial system boasts of two special courts, which include the Superior Court of Justice and the Supreme Federal Court.

Lawyers in Brazil are expected to be highly qualified due to the complex legal system. As such, the Brazilian Bar Association was established to regulate the legal profession. It is also referred to as the Order of Attorneys of Brazil. Law graduates wishing to become full practicing lawyers are required to register with the body. It unifies and organizes the Bar Examination in Brazil as well as executing disciplinary action on members found guilty of gloss misconduct charges.
